Taja Marble designs, manufactures, fabricates, and sells custom natural stone products, including but not limited to sinks, vanities, consoles, countertops, fireplaces, tables, shower trays, architectural stonework, and related products.
Natural stone is a product of nature and possesses inherent variations in color, veining, texture, density, mineral content, fossils, movement, pits, fissures, and surface characteristics. No two pieces of natural stone are identical.
By requesting a quotation, approving drawings, accepting a proposal, submitting a deposit, making a payment, placing an order, accepting delivery, or otherwise engaging in a transaction with Taja Marble, the Customer expressly acknowledges, understands, and agrees to be legally bound by these Terms and Conditions.
These Terms and Conditions constitute the entire agreement between the Customer and Taja Marble and supersede any prior verbal discussions, representations, advertisements, website content, social media content, photographs, renderings, samples, or other communications.
1. DEFINITIONS

"Seller" means Taja Marble, Taja Design Atelier, its owners, employees, contractors, representatives, successors, and assigns.
"Customer" means the purchaser, buyer, designer, architect, contractor, homeowner, developer, agent, or any person acting on behalf of the purchaser.
"Product" means any item supplied by Seller.
"Custom Product" means any product manufactured according to dimensions, specifications, selections, approvals, drawings, or instructions provided by Customer.

The majority of products supplied by Seller are custom-made.
Custom manufacturing includes but is not limited to:
- Custom dimensions
- Custom designs
- Custom edge profiles
- Custom finishes
- Custom sink configurations
- Custom mounting methods
- Custom backsplash designs
- Custom hole locations
- Custom stone selections
Once production begins, Custom Products cannot be canceled, returned, exchanged, or refunded.
Seller reserves the right to determine when production has commenced.
Material selection, slab reservation, cutting, carving, engineering, drafting, fabrication, or procurement activities shall constitute commencement of production.
3. NATURAL STONE DISCLAIMER

Customer acknowledges that natural stone is inherently variable.
Variations may include:
- Veining
- Color variation
- Shade variation
- Mineral deposits
- Fossils
- Natural pits
- Filled areas
- Resin repairs
- Movement
- Surface texture differences
- Crystalline formations
- Natural fissures
Such characteristics are expected and shall not be considered defects.
Seller does not guarantee:
- Exact color match
- Exact veining match
- Exact pattern match
- Exact replication of photographs
- Exact replication of samples
- Exact replication of previous projects
Any claim based solely upon natural variation shall be rejected.
4. PHOTOGRAPHS, SAMPLES, MOCKUPS AND RENDERINGS

Photographs, videos, samples, renderings, CAD drawings, AI-generated images, marketing images, and previous production examples are provided for general reference only.
Lighting conditions, camera settings, screen calibration, monitor settings, mobile device displays, and environmental conditions may alter appearance.
Seller does not guarantee that finished products will exactly match photographs, samples, renderings, or previously manufactured items.
5. CUSTOMER REVIEW AND APPROVAL

Customer is solely responsible for reviewing and approving:
- Drawings
- Shop drawings
- Order summaries
- Technical specifications
- Hole locations
- Dimensions
- Stone selections
- Finish selections
Approval provided by email, text message, WhatsApp, Etsy message, website communication, payment, or written confirmation shall constitute final approval.
After approval, Customer assumes full responsibility for all approved details.
6. CUSTOMER MEASUREMENTS

Customer is solely responsible for verifying:
- Measurements
- Site dimensions
- Plumbing locations
- Drain locations
- Faucet compatibility
- Cabinet compatibility
- Structural conditions
- Accessibility
Seller shall bear no responsibility for errors resulting from incorrect information supplied by Customer or third parties.
7. INSTALLATION DISCLAIMER

Seller does not perform installation.
Installation must be completed by qualified professionals.
Seller shall not be liable for:
- Improper installation
- Installer negligence
- Structural failures
- Plumbing failures
- Wall failures
- Cabinet failures
- Adhesive failures
- Silicone failures
- Fastener failures
Any damage arising during or after installation is solely Customer's responsibility.
8. WALL-MOUNTED PRODUCTS LIABILITY WAIVER

Wall-mounted products require adequate structural support.
Customer acknowledges:
- Structural requirements vary by building.
- Hidden conditions may exist within walls.
- Reinforcement may be required.
- Professional assessment may be required.
Seller provides mounting recommendations only.
Seller does not inspect walls, buildings, framing systems, substrates, or structural conditions.
Customer assumes all risks associated with wall-mounted installations.
Seller shall have no liability for collapse, movement, separation, cracking, property damage, personal injury, death, or consequential damages arising from installation or use.
9. WEIGHT DISCLOSURE

Natural stone products are heavy.
Customer acknowledges responsibility for verifying:
- Structural capacity
- Floor loading capacity
- Wall loading capacity
- Transportation access
- Handling equipment requirements
Seller assumes no responsibility for structural suitability.
10. PRODUCTION TOLERANCES

Due to the handcrafted nature of products, reasonable manufacturing tolerances are accepted.
Unless otherwise agreed:
- Dimensions ±5 mm
- Hole locations ±3 mm
- Thickness ±3 mm
Such tolerances shall not constitute defects.
11. SHIPPING TERMS

Shipping dates are estimates only.
Seller does not guarantee:
- Manufacturing completion dates
- Shipping dates
- Transit times
- Customs clearance times
- Delivery dates
Delays caused by carriers, customs authorities, ports, airports, weather, labor disputes, strikes, government actions, force majeure events, or third parties are outside Seller's control.
Such delays shall not constitute grounds for cancellation, refund, chargeback, or damages.
12. DELIVERY INSPECTION REQUIREMENTS

Customer must inspect shipment immediately upon delivery.
Any damage claim requires:
- Photographs of external packaging.
- Photographs before opening.
- Photographs during unpacking.
- Photographs of damaged areas.
- Retention of all packaging materials.
Damage claims must be submitted within 48 hours of delivery.
Failure to comply may result in denial of claims.
13. INSURANCE CLAIMS

Where shipping insurance exists, all claims remain subject to carrier and insurer approval.
Seller does not control claim outcomes.
Insurance determinations are final.
Seller reserves sole discretion regarding repair, replacement, partial compensation, store credit, or other resolutions.

All custom products are:
- Non-returnable
- Non-refundable
- Non-exchangeable
Returns require Seller's prior written approval.
Unauthorized returns will be refused.
Shipping costs, customs duties, brokerage fees, taxes, handling charges, and storage charges are non-refundable.

Production slots are reserved only after receipt of required payment.
Failure to make payments when due may result in:
- Production delays
- Shipment delays
- Suspension of work
- Cancellation of quotations
Outstanding balances may accrue collection costs and legal expenses.

Customer agrees not to initiate chargebacks, payment reversals, or payment disputes for products manufactured according to approved specifications.
Any chargeback initiated despite compliance by Seller shall constitute breach of contract.
Seller reserves the right to pursue recovery of:
- Product value
- Legal fees
- Collection costs
- Administrative expenses
- Interest
- Shipping costs
17. WARRANTY LIMITATIONS

Except where prohibited by law, products are supplied "AS IS."
Seller makes no warranty regarding:
- Merchantability
- Fitness for a particular purpose
- Compatibility with third-party products
- Long-term color stability
- Resistance to staining
- Resistance to etching
Natural stone requires ongoing maintenance.
Maintenance responsibility belongs solely to Customer.
18. EXCLUSIONS OF LIABILITY

Under no circumstances shall Seller be liable for:
- Labor costs
- Contractor costs
- Architect costs
- Designer costs
- Reinstallation costs
- Plumbing costs
- Construction delays
- Project delays
- Loss of use
- Lost profits
- Hotel expenses
- Travel expenses
- Storage fees
- Business interruption
- Consequential damages
- Indirect damages
- Punitive damages
19. LIMITATION OF LIABILITY

Seller's total cumulative liability under any theory of law shall never exceed the amount actually paid to Seller for the specific product giving rise to the claim.
This limitation applies regardless of the nature of the claim.

Seller shall not be liable for delays or failures caused by:
- Natural disasters
- Earthquakes
- Floods
- Fires
- War
- Terrorism
- Pandemic events
- Government restrictions
- Labor shortages
- Transportation interruptions
- Material shortages
- Utility failures
21. INTELLECTUAL PROPERTY

All drawings, engineering details, renderings, technical documents, photographs, and designs remain the property of Seller unless otherwise agreed in writing.
Customer may not reproduce, manufacture, distribute, or commercially exploit Seller's designs without written consent.
22. MARKETING RIGHTS

Seller may use photographs, drawings, renderings, and images of completed products for marketing, advertising, website content, social media, catalogs, and promotional purposes unless otherwise agreed in writing.
No personal information shall be disclosed without consent.
23. DISPUTE RESOLUTION

Prior to commencing litigation, parties agree to attempt good-faith negotiation.
Any unresolved dispute shall be governed by the laws of the Republic of Türkiye.
Exclusive jurisdiction shall lie with the courts of İzmir, Türkiye.
Customer expressly waives objections based upon forum non conveniens or foreign jurisdiction.
24. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Seller and Customer.
No verbal statements, promises, estimates, representations, or communications shall modify these Terms unless agreed in writing and signed by Seller.
25. ACCEPTANCE

Customer acknowledges that any of the following constitutes acceptance of these Terms:
- Requesting production
- Approving drawings
- Approving an order summary
- Making payment
- Paying a deposit
- Accepting a quotation
- Accepting delivery
- Using the product
Customer further acknowledges having read, understood, and agreed to all provisions contained herein.
