Natural stone products are heavy, fragile, handcrafted items requiring specialized packaging, handling, transportation, and delivery procedures.
By placing an order, approving a quotation, making payment, accepting shipment, or accepting delivery, the Customer acknowledges and agrees to all terms contained within this Shipping, Delivery & Freight Policy.
Shipping dates, transit times, customs clearance times, and delivery dates are estimates only and are never guaranteed unless expressly agreed in writing by Taja Marble.
Taja Marble shall not be liable for delays, damages, expenses, losses, project interruptions, contractor costs, labor costs, or other consequences arising from shipping, transportation, customs, or delivery-related events.

- UPS shipments
- DHL shipments
- FedEx shipments

- LCL shipments
- FCL shipments
- White glove deliveries
- Residential deliveries
- Commercial deliveries
- International deliveries
- Domestic deliveries

All manufacturing schedules, shipping schedules, transit times, and estimated delivery dates are estimates only.
Estimated dates may change due to:
- Production conditions
- Material availability
- Carrier schedules
- Airline schedules
- Port congestion
- Customs inspections
- Weather conditions
- Government actions
- Labor shortages
- Transportation disruptions
- Force majeure events
Taja Marble does not guarantee shipment by any specific date unless expressly agreed in writing.

Transit times provided by Seller, freight forwarders, shipping lines, airlines, or couriers are estimates only.
Transit times may vary substantially.
Customer acknowledges that delays may occur and shall not constitute:
- Breach of contract
- Product defect
- Grounds for cancellation
- Grounds for refund
- Grounds for chargeback

Customer acknowledges that Taja Marble is not responsible for:
- Construction schedules
- Renovation schedules
- Contractor schedules
- Builder schedules

- Designer schedules
- Installation schedules
- Opening dates
- Occupancy dates
Customer shall not rely upon estimated shipping or delivery dates for critical project milestones.
Any resulting delays remain solely Customer's responsibility.
5. PACKAGING STANDARDS

Taja Marble utilizes packaging methods deemed appropriate for the product being shipped.
Packaging methods may include:
- Wooden crates
- Reinforced wooden crates
- Foam protection
- Internal supports
- Edge protection
- Shock absorption materials
- Pallets
- Export-grade packaging
Seller reserves sole discretion regarding packaging methods.
Packaging appearance shall not constitute evidence of improper packaging.
6. RISK OF DAMAGE DURING TRANSPORT

Natural stone products are inherently fragile.
Despite professional packaging, damage may occur during transportation due to:
- Mishandling
- Impact
- Forklift incidents
- Carrier negligence
- Loading incidents
- Unloading incidents
- Weather events
- Transportation vibration
Transportation damage does not automatically indicate manufacturing defects or packaging deficiencies.
7. SHIPPING INSURANCE

Insurance availability varies by shipment type and carrier.
Where insurance is purchased:
- Coverage remains subject to insurer terms.
- Coverage remains subject to carrier terms.
- Approval of claims remains solely within insurer discretion.
Taja Marble does not control claim decisions and does not guarantee claim approval.
Insurance determinations shall be final.
8. CUSTOMER DELIVERY RESPONSIBILITIES

Customer shall ensure:
- Delivery access is available.
- Delivery address is correct.
- Someone is available to receive shipment.
- Appropriate unloading arrangements exist.
- Appropriate lifting equipment exists when required.
Customer is responsible for verifying that roads, driveways, elevators, stairways, hallways, and access routes can accommodate the shipment.
9. LARGE AND HEAVY PRODUCTS

Certain products may require:
- Multiple persons for handling
- Forklifts
- Pallet jacks
- Hoists
- Cranes
- Specialized movers
Customer is solely responsible for arranging any required equipment or labor.
Seller shall not be responsible for unloading, installation, lifting, positioning, or moving products beyond standard carrier delivery obligations.
10. DELIVERY INSPECTION REQUIREMENTS

Customer must inspect shipment immediately upon delivery.
Inspection must occur before:
- Product installation
- Product use
- Disposal of packaging
Customer shall inspect:
- Crates
- Pallets
- Packaging
- Product surfaces
- Corners
- Edges
- Mounting areas
Failure to inspect promptly may void shipping-related claims.
11. DAMAGE REPORTING PROCEDURE

If damage is discovered, Customer must:

Notify Taja Marble in writing within 48 hours of delivery.
Failure to follow these requirements may result in denial of claims.

Concealed damage claims must be reported within 48 hours after delivery.
Claims submitted after this period may be rejected.
Seller reserves sole discretion regarding late claims.

Delivery shall be deemed accepted when:
- Shipment is signed for;
- Shipment is delivered to designated address;
- Shipment is left according to carrier authorization;
- Customer takes possession of shipment.
Minor cosmetic packaging damage shall not constitute grounds for refusal.

If Customer refuses delivery for reasons unrelated to shipping damage or Seller error:
Customer shall be responsible for:
- Return freight
- Storage charges
- Re-delivery charges
- Customs fees
- Brokerage fees
- Administrative costs
Custom products refused by Customer remain non-refundable.
15. UNDELIVERABLE SHIPMENTS

Customer is responsible for providing accurate delivery information.
If shipment becomes undeliverable due to:
- Incorrect address
- Customer unavailability
- Failure to respond
- Refusal to cooperate
Customer shall be responsible for all resulting costs.

- Import compliance
- Import permits
- Local regulations
- Product approvals
- Import documentation requirements
- Customs procedures
Seller does not guarantee customs clearance.
17. DUTIES, TAXES AND FEES

Unless expressly agreed otherwise in writing, Customer is responsible for:
- Import duties
- Customs duties
- Taxes
- VAT
- GST
- Brokerage fees
- Clearance fees
- Government charges
Failure to pay such charges may result in shipment delays, storage fees, or return of shipment.
18. STORAGE CHARGES

If shipment is delayed due to Customer action or inaction, Customer shall be responsible for:
- Storage fees
- Warehousing fees
- Demurrage
- Detention
- Re-delivery costs
Such fees may be charged before shipment release.
19. LOST SHIPMENTS

Lost shipment investigations remain subject to carrier procedures.
Taja Marble shall cooperate with reasonable investigations but does not guarantee carrier findings or outcomes.
Claims remain subject to carrier determination.
20. FORCE MAJEURE

Seller shall not be liable for delays caused by:
- Natural disasters
- Floods
- Fires
- Earthquakes
- Severe weather
- Strikes
- Labor disputes
- Port congestion
- Customs delays
- Government actions
- Political instability
- Pandemic events
- Transportation disruptions
- Utility failures
- Material shortages
21. NO CONSEQUENTIAL DAMAGES

Under no circumstances shall Taja Marble be liable for:
- Project delays
- Contractor costs
- Labor costs
- Installation costs
- Storage costs
- Hotel expenses
- Travel expenses
- Temporary housing costs
- Business interruption
- Lost profits
- Lost revenue
- Missed deadlines
- Lost opportunities
arising from shipping, delivery, customs, transportation, or related events.
22. LIMITATION OF LIABILITY

Seller's maximum liability arising from shipping, freight, transportation, customs, delivery, delay, loss, or damage claims shall never exceed the amount actually paid to Seller for the specific product involved.

Taja Marble reserves the right to select:
- Freight forwarders
- Carriers
- Shipping methods
- Routing
- Packaging methods
unless otherwise agreed in writing.
24. PARTIAL SHIPMENTS

Seller reserves the right to ship orders in multiple shipments where deemed necessary.
Partial shipments shall not constitute breach of contract.
25. DELIVERY WITHOUT INSTALLATION

Unless expressly agreed in writing:
Seller's responsibility ends upon delivery of the product to the carrier or delivery location, as applicable under the agreed shipping terms.
Installation, positioning, mounting, plumbing connections, electrical work, sealing, and finishing remain solely Customer responsibilities.
26. EXCLUSIVE SHIPPING REMEDY

In the event of an approved shipping-related claim, Seller may, at its sole discretion:
- Repair the product;
- Replace the product;
- Provide replacement parts;
- Offer store credit;
- Offer partial compensation.
The choice of remedy belongs exclusively to Taja Marble.
Customer shall have no right to demand any particular remedy.
27. ENTIRE SHIPPING AGREEMENT

This Shipping, Delivery & Freight Policy constitutes the complete shipping agreement between Seller and Customer.
No verbal statements, estimates, representations, marketing materials, or carrier estimates shall modify these terms unless confirmed in writing by Taja Marble.
28. ACCEPTANCE OF POLICY

Customer acknowledges acceptance of this Policy by:
- Requesting a quotation;
- Approving an order;
- Making payment;
- Accepting shipment;
- Accepting delivery;
- Using the product.
Such actions constitute full acceptance of all provisions contained herein.
